Acceptance of the Terms of Service
These Terms of Service cover Fieldmotive — our website and game, which we call the "Services" together. It's a legal agreement between you as a player ("user" or "users") and us at Fieldmotive ("Company", "we", or "us"). These terms control how you can access and use the Services. WHEN YOU USE THE SERVICES, YOU'RE AGREEING TO THESE TERMS. IF YOU DON'T AGREE WITH THEM, DON'T USE THE SERVICES.
Modifications to the Terms of Service and to the Services
We can update these Terms whenever we want. When we do, the changes take effect as soon as they're posted. It's on you to check for updates. If you keep using the Services, that means you accept the changes. The Services themselves and everything in them can change at any time. We're not responsible if you can't access something or if it's temporarily down.
Use of the Services
We use industry-standard security to protect your information from unauthorized access and loss. Your account is your responsibility. Anyone who accesses it through your login has to follow these terms too. You need to keep your information up to date and correct, and let us know right away if anything changes. Nothing sent over the internet is totally secure. We do our best to protect your data, but we can't guarantee it won't be breached. That risk falls on you. If someone gets through our security, that's not on us. Don't do any of this: (a) access stuff that wasn't meant for you; (b) break through security or authentication measures; (c) mess with the service for other people; (d) fake packet headers; (e) interfere with network stuff; (f) use bots or automated tools to get into the Services; (g) upload viruses, trojans, worms, or malware; (h) run denial-of-service attacks or flooding; or (i) otherwise screw with how the system works.
Account Set-up and Subscription Services
You need to be at least 18 to set up an account. You can log in with a username and password, or through Apple ID or Google. Don't give your login info to anyone else. We can shut down your account whenever we want. If you want to unlock premium features, you can buy a subscription. They're available through our website or the Apple App Store or Google Play Store. One subscription works across all your devices. How much you pay depends on what period you choose — monthly, every six months, or yearly. We can change the price if we give you written notice, and it kicks in at your next renewal. Your subscription automatically renews at the end of each period unless you cancel it first, and you'll be charged for the same length of time. A third-party payment processor handles billing using whatever payment method you've approved. If payment doesn't go through, you lose access. You can cancel whenever you want, and it takes effect at the end of your current period. On our website, just cancel it in your account settings. If you subscribed through an app store, use their subscription management tool. After you cancel, you can still use it until your period ends, then nothing else gets charged.
Intellectual Property Rights and Ownership
Everything in the Services belongs to Fieldmotive — all the content, features, functionality, information, software, graphics, video, audio, designs, and text. It's all protected by copyright and other intellectual property laws. Trademarks and logos either belong to us or to someone else. You can't use them without permission. Using them without asking infringes on intellectual property rights and could break the law. You're allowed to use the Services for yourself, for non-commercial purposes only. Don't strip out copyright or trademark notices. You can't change it, copy it, share it, make something based on it, display it, perform it, post it again, download it, or send it anywhere without getting written permission from us first. The exceptions we do allow are: browsers temporarily caching stuff; downloading and printing copies for yourself as long as you leave the notices in; and anything that social media links specifically let you do. If you break these rules, you lose access to the Services. You'll have to give back or destroy any copies you made. You don't own anything in the Services. All the rights we didn't give you stay with us.
User Submissions and Conditions of Use
If you send us content, information, or ideas ("User Submissions"), you're saying it's your original work, nobody else has rights to it, and you're giving up any moral rights you might have. You're giving us a non-exclusive, perpetual, worldwide, irrevocable, fully transferable license to use whatever you submit for anything we want, without paying you. Your submissions can't: break any laws; violate anyone else's terms; include exploitative, obscene, harmful, threatening, abusive, hateful, explicit, violent, inflammatory, or discriminatory stuff; involve stalking or showing minors inappropriate content; ask for information we don't allow; have false or misleading info; or claim we endorse something when we don't.
Enforcement, Suspension, and Termination
We can: take action on submissions that violate these terms; send illegal stuff to law enforcement; work with authorities; shut down or suspend your access for any reason at all; and tell people who you are if we're required to. YOU'RE GIVING UP THE RIGHT TO SUE FIELDMOTIVE OR ANYONE ASSOCIATED WITH US FOR ANYTHING THAT HAPPENS DURING INVESTIGATIONS OR LAW ENFORCEMENT ACTIONS.
No Reliance
The stuff in the Services is just general information. It's not professional advice. Get proper advice before you make any decisions based on what you read here. We try to keep things updated, but we don't promise it's accurate or complete. Using the Services is your choice and your risk. We're not liable for whatever happens.
Privacy
When you use the Services, you're okay with us collecting, using, and sharing your data the way we describe in our Privacy Policy. If that bothers you, don't use the Services.
Third-Party Websites
The Services might link to other sites. We're not responsible for what's on them. Using them is on you. You have to follow their terms too. You can link to the Services in a fair and legal way without making it look like we endorse you. Don't frame the Services. We can take back linking permission whenever we want.
Online Purchases
Shopify and Stripe process purchases, and their terms and policies apply to you. Check what they require before you buy anything.
Copyright Complaints
If you're reporting copyright infringement, include: (1) your signature saying you're authorized; (2) what the copyrighted work is; (3) where it shows up on the website; (4) how to reach you; (5) a statement that you genuinely believe this is infringement; and (6) a statement under penalty of perjury. If you're sending a counter-notice, give us: (1) your signature; (2) what material was removed; (3) a statement under penalty of perjury that you genuinely believe it shouldn't have been taken down; and (4) your full contact info and consent to jurisdiction. Disclaimer of Warranties
THE SERVICES AND EVERYTHING IN THEM ARE PROVIDED "AS IS" WITH NO GUARANTEES. WE'RE NOT MAKING ANY WARRANTIES, IMPLIED OR OTHERWISE, ABOUT MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE'RE NOT SAYING ANYTHING ABOUT WHETHER IT'S COMPLETE, SECURE, RELIABLE, SUITABLE FOR YOU, ACCURATE, OR AVAILABLE. WE DON'T GUARANTEE THAT THINGS WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR VIRUS-FREE. YOU'RE RESPONSIBLE FOR YOUR OWN SECURITY. WE'RE NOT LIABLE IF YOU GET VIRUSES, TROJANS, WORMS, OR OTHER MALICIOUS CODE FROM USING THE SERVICES.
Limitation of Liability
WE'RE NOT LIABLE FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR LOST GOODWILL — WHETHER THEY COME FROM A BREACH, TORT, OR ANYTHING ELSE, EVEN IF WE KNEW IT MIGHT HAPPEN. IF MULTIPLE CLAIMS COME UP FROM THE SERVICES, THE MOST WE'LL PAY OUT IS WHATEVER YOU PAID US IN THE PREVIOUS MONTH.
Indemnification
You agree to defend us, cover our costs, and protect us from claims that come up because you broke these terms, used the Services in a way you shouldn't have, submitted something you shouldn't have, or went to third-party sites.
Governing Law and Choice of Forum
Ontario law and Canadian federal law govern these terms. Any dispute gets handled in Ontario courts. You're waiving the right to object to that jurisdiction. YOU'RE GIVING UP THE RIGHT TO BRING A CLASS ACTION SUIT AGAINST FIELDMOTIVE.
Waiver
Just because we don't enforce a right doesn't mean we lose it. Using a right partially doesn't stop us from using it later.
Severability
If any part of these terms is invalid, it doesn't affect the rest or apply in other places.
Entire Agreement
These Terms and our Privacy Policy are everything — they replace any other agreements or understandings you thought you had with us.
